I decided to use this photo of the riders of darkness for very good reason. Regardless if people like it or not, Canada is entering a place where the country has never really gone before. It is not a new concept nor idea, but the field being entered, is one that has sat on the sidelines for decades.
The provinces appear to be running the show through out this pandemic. The federal government appears to be standing on the sidelines with little to no input what so ever. When asked question about the roads provinces are walking down, it would appear that the prime minister has become weakened.
About a year ago, the Ontario premiers was suggesting a "vaccination passport" that would be required of everyone to carry. There was a loud objection from some and the idea was quietly put aside but not forgotten. Recently Quebec announced that that province will be considering a 'vaccination passport" and as close as this last week, it was reported that Manitoba is pondering the idea.
Even though the prime minister has quietly responded with a no, meaning that as a country Canada would not be supporting a "vaccination passport", however the provinces can do what they want and eventually Canada will most likely come on board with a "federal passport" to unify the country with one "vaccination passport.
How would this passport be used, is the big question. Already people to travel by plane must present their passports and visas which would indicate their vaccinations if any are required. This is true at the present time as many countries require a visa to enter into the country and the visa often states the needed vaccinations required in order to board the plane and arrive at specific destinations. For example there are countries in Africa, and countries like India where the traveler will need to first vaccinate themselves before they can enter into these countries, and for good reason.
If in Canada such a "vaccination passport" was used primarily for travel outside the country, no one would really care because of the mentioned reasons above. But that is not the case concerning the idea among the provinces. There have been suggestions that a "vaccination passport" will be needed when applying for a job. There has even been a suggestion that such a passport would be needed to make appointments, entering a mall or business, and traveling between provinces. Like your driver's license and vehicle ownership and insurance, this document will need to be on the person and be ready to show upon request of a police officer or by-law enforcement officer, etc.
Of course this is all done in the framework of protecting the general population concerning health issues. Will it stop there? You bet your ass it won't. Canada appears to be marching in the direction of "authoritarian rule" and this concept is being pushed by the provinces with the federal government unwillingly following along in silence. Yes you are correct. I am suggesting that at the federal level, there isn't any real leadership to announce to the provinces that they are stepping on federal jurisdiction where they shouldn't be traveling on.
The British North America Act of 1867, lays down the powers and authority of the federal and provincial governments. It clearly defines what powers the two levels of government have with the clear instructions that provincial laws, regulations, and legislations can not supersede federal laws, legislations and jurisdiction. But this is exactly what we are seeing at this present time, which only demonstrates how weak the federal leadership is.
Provinces have passed their own Emergency Measures Acts, all having colourful names, but in the end supersede the federal Emergency Measures Act. That in itself is unconstitutional from my understanding of the sharing the political powers. The Canadian Charter of Rights and Freedoms along with the Canadian Constitution have been violated over and over again without a single voice from the federal government. The Constitution Act of 1983 clearly advises that all laws must be passed using the Canadian Charter of Rights and Freedoms and the Canadian Constitutions as filters through which each law and piece of legislation is to be exercised. This does not appear to be happening with the provinces which have made laws and policies that have violated this due process and still the federal leadership is nearly deaf and silent in any sort of response. It appears that the federal government is standing on the side lines, only agreeing when the provinces have been getting away with their authoritarian style of rule in the controlling of the populations.
We are left standing on the precipice of authoritarian controls by the provinces as they announce their "vaccination passport" legislation, void of passing through the filters of the federal government's directions of procedures through the filters of the Charter of Rights and Freedoms and the Canadian Constitution. The passports will be spun with the all encompassing argument that such actions are for the good of the population, to protect the population's health and safety. The people will swallow this Kool-Aid and welcome authoritarian rule with open arms, believing that their provincial government knows what's best for them and are there to protect them. A trust that has neither been earned nor should be given by the population. The federal government will follow suit saying that there needs to be a unified Canadian vaccination passport which will be run by the provinces, as a means of the federal government "washing their hands" of all misconceptions of authoritarian rule and control of the population.
I am suggesting that sooner than later the citizens of each province will be hearing these words: "Papers Please." "Where are your papers?"
